Terms of Service

1. No Warranties; "As Is" Basis

The Service is provided to you on an "AS IS" and "AS AVAILABLE" basis, with all faults and defects, and without warranty of any kind. To the maximum extent permitted by law, APS Shipbrokers Associates, its affiliates, licensors, and service providers expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from a course of dealing or usage in trade.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components. We do not guarantee that any defects will be corrected or that the results of using the Service will meet your requirements. Any information or content accessed through the Service is at your own risk.

2. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall APS Shipbrokers Associates, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation damages for loss of profits, data, use, goodwill, or other intangible losses, arising from or relating to:

  • Your access to, use of, or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; or
  • Unauthorized access, use, or alteration of your transmissions or content.

This limitation applies whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other basis, even if we have been advised of the possibility of such damages.

3. Broker Capacity

APS Shipbrokers Associates acts solely in the capacity of a broker. All information, advice, and services are provided in good faith based on available data but are offered without any guarantee, representation, or warranty as to their accuracy, completeness, or suitability for any particular purpose. You acknowledge that you assume full responsibility for any decisions made based on such information.
